La contrefaçon est un phénomène généralisé qui affecte tous les secteurs industriels. Elle connaît ces dernières années un développement sans précédent et l'internationalisation des échanges ne fait que favoriser sa diffusion. Dans le cadre de l'action civile en contrefaçon, il était souvent avancé que la faiblesse des conséquences civiles de la contrefaçon contribuait à l'amplification du phénomène. La contrefaçon était en effet devenue très lucrative et contribuait à affaiblir le système des droits de propriété industrielle. Elle entraînait de plus de graves conséquences économiques au niveau de la promotion de l'innovation et de l'amélioration de la compétitivité en Europe et menaçait ainsi la réalisation du marché intérieur. La Directive 2004/48/CE du Parlement européen et du Conseil visant à renforcer le respect des droits de propriété intellectuelle au sein de l'Union européenne a dès lors été adoptée pour mettre en place un cadre juridique unique de protection. La présente étude tente de déterminer si d'une part, les mesures contenues dans la Directive 2004/48/CE sont susceptibles de renforcer le respect des droits de propriété industrielle et si d'autre part, l'initiative des autorités communautaires a permis une harmonisation des droits français, belge, luxembourgeois, allemand et anglais en matière de conséquences civiles de la contrefaçon des droits de propriété industrielle.
Infringement of industrial property rights is a widespread phenomenon that affects all industries. In recent years, it has gone through an unprecedented development, and the internationalization of trade only facilitates its expansion. In the context of civil lawsuits against infringements, it was often argued that the weakness of civil remedies contributed to the growth of the phenomenon. Indeed, infringement had become very lucrative and contributed to the weakening of the system of industrial property rights. This, in turn, resulted in serious economic consequences, hampering the promotion of innovation and the improvement of competitiveness in Europe, and thus threatened the development of the internal market. Directive 2004/48/EC of the European Parliament and of the Council on the enforcement of intellectual property rights in the European Union was therefore adopted to establish a single legal framework of protection. This study attempts to determine, on the one hand, whether Directive 2004/48/EC is likely to strengthen the respect for industrial property rights and, on the other hand, whether the initiative of the European authorities led to the harmonization of French, Belgian, Luxembourg, German and English law regarding the civil consequences of infringement of industrial property rights.
