Est-il possible d'élaborer des règles transnationales de procédure, qui pourraient être appliquées pour le règlement de certains litiges devant les tribunaux du monde entier ? Serait-ce utile ? Une telle entreprise n'aboutirait-elle pas à la domination d'un type de procédure au détriment des autres cultures ? Ou à de vagues principes sans valeur opératoire ?
Telles sont quelques-unes des questions que pose l'initiative de l'American Law Institute, et auxquels des universitaires et des praticiens français et européens ont répondu lors de cette journée d'étude. Des rapports approfondis et vifs, des discussions franches ont révélé l'importance des enjeux. Le projet américain a déjà été revu, et il est maintenant relayé par UNIDROIT. Puisque la machine semble lancée, il est bon que les embûches soient révélées. Les travaux de Paris, sans aucun doute, s'y sont employés.

Is it possible to work out transnational rules of civil procedure, which could be applied to certain disputes by national courts all around the world ? Would it be useful ? Would such a project lead to the domination of one type of civil procedure to the detriment of all other legal cultures ? Or, could it result in vague principels, without practical value ?
These are some of questions posed by the American Law Institute's initiative and which were answered by French and European lawyers, both scholars and practitioners, during this symposium. Through detailed and lively reports and frank discussions, the importance of the stakes involved was revealed. The American proposal is being revised, with UNIDROIT's participation. Since the process apparently has been put into motion, it is important to identify possible pitfalls in the project. The work done in Paris meeting has without a doubt contributed to this end
