The aim is to revive this debate, which often swings like a pendulum between ideological weight and legal argument. Depending on one's conviction as to what the content of a constitutionality review of court decisions should be, one can identify one's conception of constitutional justice. Under the terms of the February 18, 2006 constitution, article 162 sets out the mechanisms by which a constitutionality review can be raised, and its extension would lead the constitutional judge to review court decisions.
