The medical civil liability is currently dispersed and poorly regulated, generating contradictory jurisprudence, as well as the victims are not adequately compensated for this fact. This research work, therefore, aims to address the medical civil liability and the insecurity of patients attending the central hospital of the National Police of Peru "Luis N. Saenz" 2016. Identifying its elements and main consequences, in order to promote a comprehensive legislation on this issue, with emphasis on the assumption of civil liability of the physician. The justification and need to address this problem is found in the reality of our country, because in recent years, it has been noticed an increase of victims of imprudence or medical negligence in the sector, both these victims not only see their rights to health and life diminished, but facing the damage, its repair becomes in many cases a utopia or does not represent a real compensation for the damage suffered.
