Article 4 of the Organic Law of July 9, 2018 on price freedom and competition recognizes the right of any person carrying on an economic or commercial activity to set the price of their goods and services. However, there are limits to this freedom. The aforementioned organic law aims to establish clear rules by creating a competition commission under the supervision of the Minister for the National Economy, whose organizational and operational procedures are set by decree of the Prime Minister deliberated in the Council of Ministers, on the proposal of the Minister for the National Economy. Thus, in order to maintain market equilibrium, pending the signing of the aforementioned decree on the status, organization and operation of the Competition Commission, the powers vested in the latter will be exercised by the former Competition Commission created by the departmental decree of June 15 1987.
