Considering the importance of administrative activity in the implementation of fundamental rights, it is essential to delimit the jurisdictional control of the merits of discretionary administrative acts. The freedom of action of the Public Agent in the practice of this type of administrative act cannot exceed the normative limits (rules and principles) imposed, which is why the possibility of judicial control and review of the merit itself arises when it has been carried out outside the authorising and previously established normative parameters.
