The poor way in which the DRC's mining resources are exploited causes damage and death in mining areas. On the one hand, erosion is preventing mining resources from being exploited; on the other, soil degradation is causing loss of life, and surface water pollution is the cause of fatal diseases. The picture is alarming and calls for urgent measures to secure the mining environment in the DRC. The aim of this study is to examine the legal texts in force in the DRC, mainly those governing the mining sector, in order to ascertain the importance they attach to protecting the environment in this country. In other words, what constraints do these texts impose on operators in the mining sector in order to oblige them to limit as far as possible the harm they cause to the environment as a result of their activity? These questions set the scene for the analytical development that this paper intends to present.
