The problem of environmental degradation is now the subject of political debate around the world, and is perceived as a global issue. The environmental issue is part of an extremely recent general awareness, following the rise in public opinion of an "ecologist" sensibility that the powers that be must increasingly take into account. The growing awareness of national and international opinion has raised, and continues to raise, questions about the effectiveness of legal measures to protect the environment. Today's challenges are understood as a new vision of environmental protection strategy, designed to meet both the needs of economic and social development, and those of environmental conservation. To this end, in the context of the rule of law and democracy, the law is the essential tool of protection, and must take account of these issues, which will consequently transform it.
