The context is more than ever marked by an abundance of regulations, produced by two major regulatory bodies: OHADA, a legal integration community in charge of drawing up common law community regulations, and the Central Bank of West African States (BCEAO), which is the monetary authority of the West African States, in charge of specific regulations, exclusively applicable to what the law on banking regulations calls in article 2 "credit institutions" "banks" (article 3) and "financial institutions of a banking nature" (article 4).In such a context, the bank lawyer's responsibility is all the greater, and justifies the existence of legal and litigation departments.It is up to the lawyers, in relation with the bank's general management, to give content to this "Legal Affairs Department", with its direct or indirect involvement in all legal matters.The bank lawyer must also be aware of his or her role in the bank; of his or her responsibilities in drawing up and monitoring legal procedures, and of his or her role in the management of the bank.
