This book seeks through an analysis and jurisprudential evolution to shield the concept called CONSCIENTIOUS OBJECTION, as it is an eminently human - fundamental right which can be accessed if the formal requirements are met and if the reality allows it to be evidenced, preceding any event, a peaceful refusal to fulfil a normative and therefore legal duty, for reasons inherent to the thought, religion or belief. Conscientious objection is linked to the right to privacy and freedom, hence, it should be given the same treatment, in addition to the presumption of good faith of the one who promotes it, because from the formal point of view, it is established that as a general rule, the compulsory nature of military service prevails over ideas, opinions, thoughts and intimate beliefs, and the authenticity of the objection must be demonstrated, since some people certainly seek excuses not to perform their military service.
