Karl Marx (2007) will provide the tools to think of marijuana consumption as a commodity stigmatised by the State and point out the criticism of the State as a castrator of the freedom and autonomy of individual users of the herb, reinforcing the opposition of interests between the State (oppressive apparatus) and civil society (composed of social agents capable of contesting and fighting for changes in the current society); Émile Durkheim will provide the tools to think of marijuana consumption as a social fact that causes divergent and antagonistic opinions in the moral consciousness of our society and also in the dynamics of Law, which is always prone to undergo changes in time and space to adapt to the new moral consciousness of society brought and made possible by the emergence and advent of new times; Arthur Schopenhauer (2002) will provide the tools for reflection on the feeling of being imprisoned and the human suffering arising from this confinement; Friedrich Nietzsche (2007) will provide the tools to think about the proposal to legalise marijuana from the questioning of the perpetuation of the moral values of certain types of societies.
