This book contemplates the judicial and out-of-court reorganization, as well as, the common reorganization and the special one reserved to micro and small companies. Likewise, the reorganization of rural producer individual and legal entity and the transnational bankruptcy. Law no. 14112/2020 introduced changes in the Bankruptcy and Judicial Reorganization Law no. 11101/2005, especially in the part that deals with judicial reorganization. In this part, among the several innovations are: the institution of conciliation and mediation; the resolutions may be replaced by an Adhesion Instrument signed by the creditors; in case of rejection of the plan submitted by the debtor, there is the possibility for the creditors to submit a reorganization plan; tax credits are not subject to the effects of judicial reorganization, but the debtor may request the installment payment of its debts with the National Treasury.
