This paper aims to investigate the Principle of Prohibition of Deficit, addressing its historical emergence, the existence or lack of dogmatic autonomy of the principle, as well as analyze the decision of the Supreme Court, rendered in Direct Action of Unconstitutionality by Omission n. 26 and Mandate of Injunction n. 4.733, on the Criminalization of Homophobia, using the proposal for filling the normative content of the principle, formulated by Professor Jorge Reis Novais.
