Access to justice is the concrete means of asserting everyone's right to respect for the provisions protecting the environment and therefore constitutes the essential element of their application. However, accessing justice in the name of environmental protection is not easy. An adjustment of the applicable procedural rules is therefore generally necessary to ensure the right of access to justice in environmental matters. Thus the African community jurisdictions like the CJECOWAS and the CJCAE have contributed to the protection of the environment even if the latter seems insufficient and needs to be improved to be more effective.
