La promulgation de l'actuelle Constitution kenyane le 27 août 2010 a fait entrer le Kenya, en tant que pays, dans une nouvelle ère. Elle a reconnu les traités ratifiés comme faisant partie du droit kenyan. Cependant, dans cette reconnaissance, les traités ratifiés ne sont pas catégorisés. Étant donné que le Kenya était un État dualiste au moment où la Constitution a été promulguée, certains traités ont été ratifiés, mais n'ont pas été intégrés dans la législation nationale. Cela soulève la question de leur statut au regard de la Constitution.
