IL LUOGO DEI TRATTATI RATIFICATI MA NON RATIFICATI - PRIMA DELLA PROMULGAZIONE DELLA COSTITUZIONE: UNA VALUTAZIONE DELL'ARTICOLO 2(6) DELLA COSTITUZIONE DEL KENYA, 2010. DE

La promulgazione dell'attuale Costituzione keniota, avvenuta il 27.8.2010, ha inaugurato un nuovo regime per il Kenya come Paese. Essa ha riconosciuto i trattati ratificati come parte del diritto del Kenya. Tuttavia, nel riconoscimento, i trattati ratificati non sono classificati. Poiché al momento della promulgazione della Costituzione il Kenya era uno Stato dualista, vi erano trattati ratificati ma non recepiti. Ciò solleva la questione del loro status ai sensi della Costituzione.
