Allah SWT sent down Islamic Shari'a (law) to regulate human life, both as individuals and as members of society. This is different from the concept of law outside Islam which is only intended to regulate human life as a society (odening van het sociale leven). In the view of law outside Islam, that law is the result of the process of human life in society, as expressed by Cicero, that Ubi Societas Ibilus (where there is society there is law) (Usman, 2001: 65). Maintaining the survival of children is the responsibility of parents, which should not be ignored. Article 45 of Law no. 1 of 1974 concerning the principles of marriage, stipulates that parents are obligated to maintain and educate children who are not yet mature until the children concerned are adults or can stand on their own.
