It is very important to underline that, in order to get an idea of the cases brought to their attention, the courts and tribunals first undertake the exercise of verifying the regularity of their referral. It passes by the examination of the exploits or acts used in any matter. The practice is all the more widespread as, very often, the preliminary debates gravitate as well on the mentions of drafting and service of the introductory documents as on the competence of the jurisdictions.The need for justice is inherent to man because "justice raises a nation", writes the Bible. It is a true social necessity that in order to preserve peace, cohesion, harmony and balance, the citizens must find their account in the justice of the country. The judge has indeed the heavy responsibility to secure all the parties and persons called to the case or the cause, having in mind that "the man has more need of security than of justice".
