Analysis of the influence of Mobbing as a causative element of occupational accidents is the general objective of this work, highlighting the existing problem in the development of psychosocial risks that affect emotionally, physically and psychologically workers today. For this, different expert authors were analyzed, as well as the legal norms of the Constitution of the Bolivarian Republic of Venezuela, the Lopcymat, its regulations, the Constitution of the Republic of Ecuador, the Ecuadorian Labor Code, the Ecuadorian Penal Code. Determining how the main purpose of moral harassment is to intentionally and premeditatedly cause psychological damage to the victim, which motivates the same to withdraw from their workplace, this is how this phenomenon can easily be considered as a justified cause for withdrawal, because the negative stimuli to which the victim is exposed violate in an incalculable way their human rights.
