Pope v. Whitcombe, p. 686, is now reprinted for the reason stated in the foot-note there. The learned reader will not omit to note that Stirling, J. Cited the case for one only of two points. On the other the case was not, indeed, wrongly decided, but was wrongly reported, as Lord Romilly declared, after verifying the decree in the Registrar's book, in Finch v. Hollingsworth, 21 Beav. At p. 116. As the case is reported only or relatione, it is no disparagement to Merivale's general accuracy as a reporter.
