In Mattock v. Kinglake, 10 Ad. E 50, Patteson, J., said: Pordage v. Cole is d1rectly in point. We must overrule it if we decide in favor of the defendant, and since a time was fixed for payment and none for conveyance, the court allowed the plaintiff to recover the price without conveying or offering to convey.
