The origin of private property, and concerns for its security was the foundational justification for the emergence of Commonwealth. Prior to human's civilization the whole Universe was the Common Heritage of Mankind. Later on, selfish, nasty, and brutish human nature brought parochial considerations into the cosmopolitan framework, in a way, the birth of Leviathan was inevitable. Human's positivism excelled in quest of new habitable worlds, resulted into humankinds' successful journey in Outer Space. Outer Space was declared as the 'Common Heritage of Mankind.' This principle does appear oxymoron in its application to the Outer Space; because, capable countries are enjoying de facto sovereignty in Outer Space, and poor countries are, incapable, in fact, unaware of what is really happening over there.CHM has emerged as an impediment for freedoms in exploration and exploitation of Outer Space, because, it does not allow any incentive for the explorers. This principle is neither inclined towards the Hobbesian Sovereignty nor Kantian Cosmopolitanism; rather CHM is mystically unclear concept. A groundwork is an attempt to throw light amidst darkness pervading in Outer Space.

Mr. Mritunjay Kumar has obtained Master of Laws (LL.M.) degree from Faculty of Law, University of Delhi. The groundwork of Common Heritage of Mankind in Outer Space is a first ever attempt on the part of author to establish perpetual peace in Outer Space.
