Summary

Land Law: Theory and Practice provides a fresh, new approach to the study of land law. Combining a clear and accessible explanation of the law with detailed analysis of the case law and statutory provisions, the book goes beyond a black letter approach to offer insight into the tensions and policy issues which shape the law. Addressing all of the topics commonly covered by land law modules on both the LLB and the GDL, the book provides students with a comprehensive framework for their studies which helps them to appreciate the wider social, political and economic context within which land law operates.
The book outlines the basic principles of land law and the essential conceptual underpinnings of the discipline, and explores these key themes throughout the text. It takes a critical slant to the dominant approach to land law taken in most textbooks which is to see land as primarily a commodity for transfer and introduces students to alternative perspectives on land such as use and enjoyment. It also explores the concept of property both in relation to land and personal property, to consider the fine line between a property right and a personal right.
With a focus on real issues, both practical and theoretical, the book not only provides students with a detailed and comprehensive account of contemporary land law, but makes for an engaging and stimulating read students of Land Law at any level.
