This book provides a comparative study about the most important constitutional right of human being in the perspective of positive law and Islamic law as well. This right is called freedom of opinion or freedom of expression, which is the basic right for all of the fundamental right, and it is a crucial point for developed countries. Even though this right seems to be an absolute right, there are some justifiable restrictions upon it due to the nature of this right and human being in society. The comparative in this book has been made between positive law and Islamic law in regards to the right of freedom of opinion. In addition, we have selected the American legal system as an example for positive law and compared to the Islamic legal system towards this fundamental right.

About the author










Omed A. Ismail is a Kurdish author from Iraq. He is living in Sulaumaniyah and obtained his Master degree in Michigan State University/ College of Law in the area of Intellectual Property. Nowadays, the author is a lecturer in the University of Human Development in Sulaymaniyah. He is also a legal adviser in Sulamaniyah governorate.
