485 ff. ZPO und einer einstweiligen Duldungsverfügung nach

935 ff. ZPO auszeichnet und deren Vorteile vereint. Der Schutzrechtsinhaber erhält auf diese Weise eine gerichtliche Handhabe außerhalb eines Hauptsacheverfahrens, mit deren Hilfe Informationsdefizite schon vor der Einleitung eines Prozesses bewältigt werden sollen. Durch die beschriebene Kombination wird das gesamte Verfahren geregelt, von der Besichtigungsanordnung über die Besichtigung und Gutachtenerstellung durch den Sachverständigen bis zur Gutachtenherausgabe an die Parteien.
